NURSING HOME ABUSE AND NEGLECT - NEW JERSEY

NURSING HOME ABUSE

The attorneys of Michael J. Glassman & Associates is located in Voorhees, NJ. We have successfully represented clients whose loved ones are in nursing homes and have been abused or neglected. In New Jersey, nursing home patients have rights.

It is the responsibility of all nursing homes to provide needed care and assistance to their residents but, sometimes, their employees abuse or neglect vulnerable individuals. Your loved one deserves professional care and a decent living environment. You should always be aware of the signs of abuse and neglect and be prepared to take action if you suspect either.

Certain problems that occur in a nursing facility demand action by the nursing home management and physician and, if not immediately resolved, require outside assistance. These problems include:

  • Unexplained bruising
  • Bed Sores
  • Fractures
  • Falls
  • Unexplained Injuries
  • Malnutrition/Dehydration
  • Rapid Weight Gain or Loss
  • Sexual Abuse
  • Assault
  • Wandering
  • Unsanitary Conditions
  • Inadequate Staffing
  • Medication Errors
  • Unexpalined infections
  • Burns
  • Unexpected Death
Every nursing home is required to immediately inform the resident's guardian of any significant change in physical or mental condition, or any other meaningful problem. Family members should insist on meeting with the Director of Nursing or the Administrator. Family members should also insist on the involvement of the patient's doctor or the medical director of the facility in resolving these problems.

A discussion between the family and the staff should include what the problem is, what is being done to solve the problem, and how future problems will be prevented. If these attempts to resolve problems fail, you may wish to seek the help of an attorney experienced in nursing home cases. In situations involving serious injury or death of a resident, it is always advisable to consult with an attorney.

When dealing with nursing homes:

  • NEVER sign a legal document that you do not understand
  • NEVER agree to limited access to your loved one
  • NEVER accept a substandard quality of life for your loved one
  • NEVER give up

If the administrator of the facility is unable to solve your problem, you have other options. In cases involving abuse, serious injury to the resident, or death, calling an attorney should be the first step. We have extensive experience representing families who are dealing with these difficult issues and would be happy to discuss these problems with you.

What are the rights of residents of New Jersey's nursing homes?

All New Jersey nursing homes must:

  • Provide proper medical and nursing home care for all residents
  • Protect resident funds

  • Honor the privacy and confidentiality of each resident

  • Ensure that residents are free from physical restraints used for purposes other than to treat medical symptoms

  • Develop and implement written policies and procedures that prohibit mistreatment, neglect, and abuse of residents and misappropriation of resident property

  • Promote the quality of life for each resident

  • Protect the dignity of each resident

  • Encourage all residents to participate in the planning and decisions related to care and treatment and to make choices about significant aspects of his or her life in the facility

  • Provide each resident with the right to receive services with the reasonable accommodation of individual needs and preferences, without endangering the well being of the individual or other residents

  • Provide an ongoing program of activities designed to meet the interests and physical, mental and psychosocial well being of each resident

If any one of these rights are violated, New Jersey's comprehensive law provides substantial rights.
